Driver Qualification File Checklist: What FMCSA Requires
If you run commercial motor vehicles in interstate commerce, FMCSA expects a driver qualification file for every driver. That includes owner-operators driving under your authority. It is a short list of documents, but each one has its own deadline: some before the first trip, some within 30 days, and some every year.
This post covers what goes in the file, when each piece is due, how long you keep it, and how to set WorkZerk up to collect the driver's side of it.
Who needs a file
Part 391 applies to motor carriers and the drivers they use. FMCSA's definition of an employee includes "a driver of a commercial motor vehicle (including an independent contractor while in the course of operating a commercial motor vehicle)". So an owner-operator leased to you needs a file just like a driver on your payroll.
What goes in the file
49 CFR 391.51(b) lists the contents. In plain terms:
| Document | Where the rule is | Who supplies it |
|---|---|---|
| Employment application | 391.21 | The driver, on your form |
| Motor vehicle record (MVR) from each state that licensed them in the last 3 years | 391.23(a)(1) | You order it |
| Road test certificate, or a copy of their CDL instead | 391.31, 391.33 | You, or the driver's CDL |
| Annual MVR | 391.25(a) | You order it |
| Note of your annual review of the MVR | 391.25(c)(2) | You write it |
| Medical examiner's certificate | 391.43 | The driver |
| Any medical variance or skill performance evaluation certificate | 391.49 | The driver, where one applies |
The previous-employer investigation from 391.23 sits alongside it, in the driver's investigation history file (391.53).
The application
The application must be on a form you provide, completed and signed by the driver (391.21). Among other things it asks for:
- Every unexpired commercial license or permit, with its number and expiry date.
- Accidents and moving violations in the last 3 years.
- Any license suspension or revocation, or a statement that there was none.
- Every employer in the last 3 years, with dates and the reason they left.
- For CDL drivers, every employer they drove a commercial vehicle for in the 7 years before that, so 10 years in all.
It ends with the driver's signed certification that they completed it and the entries are true.
Within 30 days of hire
391.23 sets two checks, both within 30 days:
- The state record. Ask each state that licensed the driver in the last 3 years for their MVR, covering those 3 years.
- Previous employers. Ask every employer that had them driving a commercial vehicle in the last 3 years about accidents and their drug and alcohol testing history.
For FMCSA-regulated employers, the drug and alcohol part now runs through the Drug and Alcohol Clearinghouse (391.23(e)(4)). The driver has to consent. Without consent, the driver can't operate a commercial vehicle for you.
Before the first trip: the Clearinghouse
You can't put a driver in a safety-sensitive job without first running a pre-employment query in the Clearinghouse (382.701(a)). A full query needs the driver's specific consent, which they give inside the Clearinghouse. So the driver needs a Clearinghouse account before you can hire them.
Every year
Three things repeat at least every 12 months:
- Order a new MVR from each state that licensed the driver (391.25(a)).
- Review it and keep a note with the reviewer's name and the date (391.25(b) and (c)).
- Query the Clearinghouse again (382.701(b)). A limited query is enough with the driver's consent. If it shows there is information, you run a full query within 24 hours.
Medical cards
Most drivers must be re-examined if they haven't been certified in the past 24 months (391.45(b)). Some must be re-examined every 12 months, such as insulin-treated drivers and drivers who don't meet certain vision standards. An examiner can also issue a certificate for less than 24 months, so go by the date printed on the card.
The examiner has to be on FMCSA's National Registry of Certified Medical Examiners.
How long to keep it
Keep the file while the driver works for you and for 3 years after they leave (391.51(c)). The annual MVRs, the review notes and the medical certificates can be removed 3 years after they were made (391.51(d)).
This is general information, not legal advice. Intrastate drivers can fall under state rules instead, and hazmat, passenger and tank work add their own. Check with FMCSA, your state, or a lawyer for your situation.
What WorkZerk does with a driver qualification file
WorkZerk collects the parts that come from the driver:
- Each driver gets a private link on their phone, with no account or password. They upload their CDL front and back, their medical card and their signed application, list their previous employers, and confirm they have consented to the Clearinghouse query.
- The CDL and medical card carry expiry dates. WorkZerk can email the driver 30 days before either one expires.
- You approve each document, and WorkZerk records who approved it and when.
- The CDL, the medical card and the application are marked sensitive: stored encrypted, masked for your team, and only admins can open them.
- The Document compliance report shows who is current, expiring, expired or missing across all your drivers.
What it does not do: WorkZerk doesn't order MVRs, run Clearinghouse queries, or ask previous employers for their records. It doesn't check a CDL or a medical card with the state or the examiner. Those steps stay with you, and WorkZerk keeps the documents, the dates and the record of who approved them.
Setting it up in WorkZerk
1. Turn on two-factor authentication
Asking people to upload documents needs two-factor authentication on your account. Set it up under Account, then Two-factor authentication (opens in WorkZerk in a new tab).
2. Add the driver pack
Open a portal from Portals (opens in WorkZerk in a new tab), or create one such as "New drivers". On its Requests panel, pick Driver onboarding (United States) from the pack picker. It asks for:
- The CDL, front and back, with its expiry date.
- The CDL class and endorsements.
- The DOT medical card, with its expiry date.
- The signed driver application.
- Previous employers for the last 3 years.
- A task to register with the Clearinghouse and approve your query.
Then add the Staff onboarding (United States) pack for employees, or Contractor onboarding (United States) for owner-operators. Those hold the W-4 or W-9 and the bank details. See starter request packs.
3. Attach your application form
The application has to be on your form. Open the Driver application request on the portal and use Attach a document, link or YouTube video to add your form, or pick it from your Files (opens in WorkZerk in a new tab) library. The driver downloads it, fills it in and uploads it signed. See attaching a document or video to a request.
4. Ask owner-operators for their truck papers
The driver pack ends with an Owner-operators section: USDOT number, registration, annual inspection report and auto liability insurance, all optional. To hide them from employee drivers, add a Choice question such as "Are you driving your own truck?", put those four requests in a Section, and use Limit who sees this to show it only on Yes. See asking for documents and info.
5. Review and approve
Uploads wait under Needs review on Requests (opens in WorkZerk in a new tab). Check the name and dates against the CDL, check the examiner on the National Registry, then approve. Reject anything that falls short and say why. See reviewing uploads.
6. Switch on the reminders
Open Automations (opens in WorkZerk in a new tab) and switch on Document expiring reminder and Document expired reminder. Both start switched off. The driver hears 30 days before their CDL or medical card expires.
The annual MVR review and Clearinghouse query are your jobs, not the driver's. Add an Upload field such as Annual MVR review on Fields (opens in WorkZerk in a new tab) with Require an expiry date ticked. Attach each year's MVR and review note to the driver's contact record, with the next review date as the expiry. Then build a rule on Document expiring with Send account email, so the reminder reaches you. See automations.
7. Check who is covered
Open Requests (opens in WorkZerk in a new tab) and click Document compliance. Each driver shows as current, expiring, needs review, expired or missing for each document. Use Download CSV when an auditor or a customer asks for your records. See document compliance.
